Terms of Service

These Terms of Service (“Terms”) govern access to and use of MapLeads, a service that extracts and enriches business listing data from Google Maps, Apple Maps, and Bing Maps, and delivers it through a web dashboard and a developer API (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use MapLeads. You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account.

2. The Service

MapLeads runs scrape jobs against Google Maps, Apple Maps, and Bing Maps on your behalf, enriches the resulting business records with emails, phone numbers, websites, and social profiles where discoverable, and makes results available through the dashboard, CSV, Excel, and JSON export, and a REST API. Data source coverage, enrichment accuracy, and result volume depend on what each mapping provider and public sources make available at the time of your search, and are not guaranteed to be complete or error-free.

3. Plans, Billing, and Trials

MapLeads is offered on paid subscription plans (currently Lite, Pro, and Max), billed monthly or annually through Stripe, each with a monthly lead/credit allowance and feature set described on our Pricing page. New subscriptions start with a 3-day trial; a valid payment method is required to begin the trial, and your card will be charged automatically when the trial ends unless you cancel first. Plan changes (upgrades, downgrades, or switching billing period) are prorated and take effect as described in your customer billing portal.

4. Payment Authorization

By providing a payment method, you authorize MapLeads and Stripe to charge that payment method for your selected plan, on a recurring basis, until you cancel. You are responsible for keeping your payment method current; a failed renewal charge may result in suspension of access to the Service.

5. Refunds, Cancellations, and Payment Disputes

You may cancel your subscription at any time from the customer billing portal; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by applicable law, subscription fees and credits already consumed are non-refundable. If you believe you were charged in error, contact [email protected] before filing a payment dispute or chargeback — we will work with you to resolve billing issues directly.

6. Acceptable Use

You agree not to use MapLeads to:

  • Violate the terms of service of Google, Apple, Bing, or any other source the Service extracts data from, beyond what MapLeads itself is designed to do on your behalf;
  • Attempt to circumvent rate limits, credit allowances, or account restrictions;
  • Share, resell, or sublicense your account or API keys to third parties outside your own organization without our consent;
  • Send unsolicited bulk communications (spam) using data obtained through MapLeads in violation of applicable anti-spam law (e.g. CAN-SPAM, CASL, or equivalent); or
  • Use the Service to build a competing map-data scraping or lead-extraction product.

7. Your Data and Compliance Responsibilities

MapLeads extracts and delivers publicly available business listing information. You are solely responsible for how you use that data — including ensuring your own outreach, marketing, or storage of the exported records complies with applicable law (such as CAN-SPAM, TCPA, GDPR, or similar regimes in your jurisdiction). MapLeads is a data tool, not a compliance service, and does not vet your downstream use of exported leads.

8. API, Limits, and Availability

API access is subject to the rate limits and concurrency allowances of your plan. We aim for high availability but do not guarantee uninterrupted access; the Service is provided on an “as available” basis and may be subject to scheduled maintenance or unplanned downtime.

9. Intellectual Property

MapLeads and its underlying software, branding, and documentation are owned by MapLeads and its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service and the data it produces for your internal business or your clients' business purposes. You retain ownership of any data you upload or configurations you create within the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that extracted or enriched data will be accurate, complete, or current at all times.

11. Limitation of Liability

To the maximum extent permitted by law, MapLeads and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid to MapLeads in the twelve (12) months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless MapLeads from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights, including through your use of data exported from MapLeads.

13. Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a security or legal risk to MapLeads or others. You may stop using the Service and cancel your subscription at any time as described in Section 5.

14. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify active account holders by email or in-app notice before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Governing Law and Venue

These Terms are governed by the laws of [Jurisdiction to be confirmed], without regard to conflict-of-law principles, and any dispute arising from these Terms or the Service will be brought exclusively in the courts located in that jurisdiction, except where applicable law requires otherwise.
